EQUIPMENT RENTAL AGREEMENT

Responsibility and Use & Disclaimer Warranties.

You are responsible for the use of the rented items. You assume all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnity and hold ZIP Party Rentals harmless from and hereby release ZIP Party Rentals from, all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from ZIP Party Rentals negligence, from the defective condition of the items, or any other cause.

 

Equipment Failure.

You agree to immediately discontinue the use of rented items should it at any time become unsafe or in a state of disrepair, and will immediately (one hour or less) notify ZIP Party Rentals of the facts. ZIP Party Rentals agrees at our discretion to make the items operable in a reasonable time, or provide a like items if available, or make a like item available at another time, or adjust rental charges, The provision does not relieve renter from obligations of this contract. In all events ZIP Party Rentals shall not be responsible for injury or damage resulting in failure or defect of rented item.

 

Use of Equipment.

Renter agrees & covenants to be satisfied with the instruction and condition of equipment rented and the proper and safe use equipment, or that renter is so familiar and conveyed to ZIP Party Rentals you were. Renter further agrees that the items will only be used at the address listed on contract, and only for the purpose for which it was intended and manufactured. Subleasing or improper use is prohibited. Renter agrees they have read all instruction manuals, operating instructions, and warnings related to rented items.

 

Equipment Responsibility.

Renter is responsible for equipment from time of possession to time of return. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, damaged, renter will assume cost of replacement or repair, including labor costs. Renter shall pay a $2 per each rented item with a minimum charge of $100 per order, cleaning charge for rented items returned dirty (excluding table covers, tablecloths). In case of equipment loss or unfixable damage Renter has to cover each price per item: 1(one) Round Table 48” is $100, 1(one) Round Table 60” is $150, 1(one) Rectangle 6’ Table is $100, 1(one) Rectangle 8’ Table is $170, 1(one) Garden Chair is $50, 1(one) Premium Chair is $30,  1(one) 10’ x 20’ Canopy tent is $450, 20’ x 20’ Canopy Tent $900, 20’ x 30’ Canopy Tent $1400, 1(one) 20’ x 20’ High Peak Frame Tent $4400, 1(one) 20’ x 40’ High Peak Frame Tent $9000, 1(one) 20’ x 60’ High Peak Frame Tent $12,000, 1(one) pop-up tent roof fabric is $200, 1(one) inflatable $1600, 1(one) table linen $30, 1(one) chair cover is $3, 1(one) Tall Cooler $250, Dance Floor (12’ x 12’) $4,500 for entire set and/or $250 per each piece if less than half of it is damaged,  Artificial Flower wall, $1,400 a piece, light fix $200.

 

Time of Return.

Renter’s right of possession terminates upon the expiration of rental period set forth on the contract. Time is of the essence in this contract. Any extension must be agreed and specified at “Notes/Special Requests” section of this contract.

 

Late Returns.

Renter shall return rented items to ZIP Party Rentals during our regular business hours, promptly upon, or prior to expiration of rental period. If renter does not timely return, the rental rate shall continue until items are returned. Every hour after set pick up time if ZIP Party Rentals are not available to pick up any of the equipment due to Renters fault will be charged $15 per each 10 minutes late fee.

 

Payment.

Renter shall pay all charges payable on this contract in advance, provided however that all forgoing shall not limit the amount of payable by renter hereunder and all additional amounts hereunder shall be paid immediately as such costs are incurred. Renter shall pay all reasonable costs of collections, court, and attorney fees. If rental charges are not paid 

 

within (10) days of the due date, ZIP Party Rentals at our discretion may re-calculate rental charges on a daily basis. Renter shall pay in addition to any other amounts payable hereunder, a service charge 5.0% per month on all past due accounts.

 

Reservation Deposit & Cancellation Policy

Orders Under $2,000:
No deposit is required for rental orders with an initial quoted total of less than $1,000, unless otherwise agreed upon in writing with ZIP Party Rentals.

Orders of $2,000 or More:
A 25% reservation deposit, based on the total amount of the initial quote, is required. The deposit must be received within three (3) days of the date the quote is issued, unless different arrangements have been agreed upon in writing with ZIP Party Rentals. The reservation is not considered secured until the required deposit has been received. Te balance payment is due upon the delivery.

Cancellations.
If a reservation requiring a deposit is canceled, the deposit will be non-refundable and forfeited.

For reservations where no deposit was required or collected, acceptance of this Rental Agreement still makes the Renter responsible for all applicable cancellation fees.

If a reservation is canceled within thirty (30) days of the scheduled Event Date, the Renter will be charged a 50% cancellation/restocking fee based on the original rental order total. Any deposit already paid will be applied toward the 50% cancellation fee.

 

Additional charges.

In addition to other charges and cost provided herein, renter shall pay charges in accordance with company rates then in effect for the following services. Delivery and/or Pick up to any location other than level ground. Set up of tables and chairs. Delivery and Pickup after business hours, Saturdays, Sundays, and Holidays. Packaging materials not returned. Service calls. Site survey and preparation.

Delivery & Pickup.

Renter shall clean and properly repackage all rented items in their original packaging and stacking configuration prior to pickup. If ZIP Party Rentals agrees to pick up the rented items, the Renter shall make all equipment fully accessible and available for pickup at a mutually agreed, safe, and accessible location.

Delivery and pickup scheduling shall remain at the sole convenience and operational discretion of ZIP Party Rentals. Due to rapidly changing and dynamic weather conditions, traffic, equipment logistics, route changes, emergency situations, delays at prior events, labor shortages, road conditions, or other force majeure events beyond our reasonable control, ZIP Party Rentals is unable to guarantee an exact delivery or pickup time. ZIP Party Rentals may provide an estimated delivery or pickup time window, typically ranging between approximately 3–6 hours; however, all estimated times remain subject to change without notice. Pickup times are also estimates and are commonly discussed or determined during delivery/setup. ZIP Party Rentals may, at its sole discretion, send a courtesy notification approximately 10–30 minutes prior to arrival for pickup or delivery; however, such notification is not guaranteed, required, or promised under this Agreement. The Renter agrees to ensure that: The property and equipment are fully accessible upon arrival; All rented items are properly prepared for pickup; Gates, pathways, garages, elevators, loading zones, and access points remain unlocked and available; Pets, vehicles, debris, guests, and obstructions are cleared from pickup and delivery areas; Required personnel are available to assist if previously agreed. If ZIP Party Rentals is delayed, prevented, obstructed, or unable to complete delivery, installation, pickup, loading, unloading, or removal of equipment upon arrival due to the Renter, guests, venue staff, blocked access, unsafe conditions, inaccessible equipment, or any circumstances outside of ZIP Party Rentals’ control, the Renter agrees to pay additional waiting, labor, and rescheduling charges as follows: First 10 minutes: grace period. After first 10 minutes: additional charge of $50 per each additional 15-minute interval. These charges apply regardless of whether the delay occurs during delivery, setup, pickup, dismantling, loading, unloading, or equipment retrieval. Renter further agrees to pay any additional service charges incurred for: Extra delivery or pickup attempts; Return trips; Delayed access; Stair carries; Long-distance carrying; Unsafe site conditions; Weather-related delays caused by lack of preparation; Equipment relocation requests after setup has been completed. If not otherwise agreed in writing: Table setup and takedown service shall incur an additional fee of $1 per table; Chair setup and takedown service shall incur an additional fee of $0.50 per chair. Failure to make equipment available for scheduled pickup may also result in continued rental charges, additional labor fees, storage fees, and/or legal collection action if necessary.

Liability for Tent Placement on Private Property.

If the renter requests that ZIP Party Rentals install a tent or other equipment on their property (or property they have been granted written or verbal rights to use), the renter assumes sole liability for any and all damages to the property or surrounding areas. This includes, but is not limited to, damage to sprinkler systems, gas lines, power lines, utility lines, septic tanks, water lines, drainage systems, communication cables, or any other underground or above-ground structures.

The renter (property owner or authorized user) is fully responsible for:

Marking all underground and above-ground utilities and protective areas prior to equipment delivery and installation.

Providing a clear and safe installation area that ensures no risks to ZIP Party Rentals employees, contractors, or volunteers during setup and takedown.

Ensuring accuracy of utility locations — ZIP Party Rentals cannot guarantee that lines and utilities remain in the original placement made by service providers, nor can we verify if they have been moved, altered, or relocated by third parties without proper notice.

If local law requires ZIP Party Rentals to request official utility marking services, ZIP Party Rentals will comply. However, final confirmation of the installation location and clearance remains the sole responsibility of the renter/property owner.

By agreeing to this contract, the renter acknowledges and accepts full liability for any damage or incidents arising from equipment installation on their property, regardless of location, and releases ZIP Party Rentals from all responsibility or claims related to such issues.

 

Prohibited Use of Tent Fabric.

The renter agrees that no taping, gluing, pinning, stapling, or any other method of attaching items to any fabric portion of ZIP Party Rentals’ tents (including walls, roofs, or side panels) is permitted.

Any evidence of such actions will result in:

A fine of $200 for violation; and/or

Replacement cost of the damaged piece(s) as follows:

Marquee Tent Roof: $3,000

Canopy Tent Roof: $350

Canopy Tent Wall (per wall): $100

Marquee Tent Wall (per wall): $400

The renter is fully responsible for these costs if damage is discovered, regardless of whether the renter or their guests caused the damage.

 

Care of Equipment.

In addition to other responsibilities outlined herein, the Renter agrees to the following:

1. Safeguard the rented equipment from weather-related damage, breakage, unauthorized or improper usage, theft, or loss while under the Renter's care.

2. Remit a cleaning fee of $2 per rented item, with a minimum charge of $100 per order, for any items returned in a dirty condition (this excludes table covers and tablecloths).

3. Refrain from affixing any decorations to the fabric components of the tents (including walls and roofs). Any evidence of such decorations will result in the item being classified as "DAMAGED," incurring a charge equivalent to the full purchase price of the item as described in section “Equipment Responsibility.”.

 

Insurance.

Renter shall maintain, at renter's expense, liability, property and casualty insurance coverage in amount sufficient to fully protect ZIP Party Rentals and its equipment against any and all claims, loss, or damage. In the event of loss or damage, you shall exercise, and shall empower us to exercise all your rights to obtain recovery under insurance and shall cooperate with ZIP Party Rentals to obtain recovery. All insurance proceeds should be given or assigned to ZIP Party Rentals.

 

Site Preparation. 

Renter agrees to have site cleaned and ready for delivery and installation or dismantled for pickup or the equipment, and also agrees to pay any additional charges of $50 per 15 min for any delay incurred along with any labor charges resulting in renter's failure to do so.

 

Permits & Licenses.

Renter agrees prior to any installation of rental equipment including tents, to obtain at renters expense, any and all necessary permits and licenses and other consents.

 

Subsurface Conditions.

Renter agrees to obtain any locating of underground utilities before delivery of rented items. Renter also agrees to reimburse ZIP Party Rentals for any additional costs incurred as a result of undisclosed or subsurface conditions. ZIP Party Rentals is NOT responsible for any damage to underground sprinkler systems during tent and/or inflatable installations. It is the customer's responsibility to provide ZIP Party Rentals with a sprinkler line layout to decrease the risk of damage to a sprinkler line. However, even with a line layout there are no guarantees.

 

Hold Harmless Agreement.

Renter agrees all risk, and agrees to hold ZIP Party Rentals and any of its staff harmless from and against any and all claims, losses, liabilities, and damage, and all costs and expenses arising directly and indirectly at or relating to; The delivery, loading, unloading, erection, installation, dismantling, and use of rented equipment. Contact of underground utilities, pipes, or any condition on renter's property. All necessary surface repairs. Any injury or damage during the use of rented equipment including inflatables, and any interactive games.

Damage Waiver.

Renter agrees to the damage waiver charge as specified, subject to the limitations and exclusions below, ZIP Party Rentals Rentals agrees to modify the terms of this contract and relieve you of liability for accidental damage to the rented item(s) on this contract, and for loss due to fire, collision, windstorm, upset, riot. We exclude from this waiver, however, any loss or damage due to theft, misuse or abuse, by conversion, intentional damage, mysterious disappearance or other loss due to your failure to care for the rented item(s).

 

Property Surface Damage Disclaimer

Renter acknowledges that delivery, transportation, setup, installation, staking, anchoring, use, dismantling, and pickup of rental equipment may require ZIP Party Rentals vehicles, trailers, dollies, carts, machinery, stakes, anchors, barrels, weights, and personnel to access or operate on grass, soil, gravel, concrete, asphalt, pavers, patios, driveways, sidewalks, landscaping, and other surfaces.

Renter understands and accepts that such activities may result in unavoidable marks or damage including, but not limited to, tire marks, ruts, mud, grass damage, soil shifting, cracks, scratches, indentations, paver shifting, asphalt or concrete marks, stake holes, and other surface impact caused directly or indirectly by equipment, transportation, weather conditions, or ground conditions.

ZIP Party Rentals shall NOT be responsible or liable for any damage to grass, landscaping, soil, irrigation systems, gravel, concrete, asphalt, pavers, patios, driveways, sidewalks, underground systems, decorative surfaces, or any other property surface accessed, crossed, staked, weighted, or utilized during delivery, setup, installation, dismantling, transportation, or pickup operations.

 

Photo & Media Release.

By entering into this agreement, the renter grants ZIP Party Rentals permission to photograph, video record, and otherwise capture images of our rental items while set up on the renter’s property or event location. These images may include portions of the renter’s property, décor, or event setting.

ZIP Party Rentals retains the right to use such images for promotional, marketing, and advertising purposes, including but not limited to use on our website, social media platforms, print materials, and other marketing channels.

The renter waives any right to inspect or approve the finished images or media, and agrees that no compensation will be provided for the use of such content.

If the renter does not wish to allow photography or use of images from their event/property, they must notify ZIP Party Rentals in writing prior to delivery of rental items.

 

Payment options.

At this time, we do not accept card payments. For your convenience, we currently accept cash and Zelle payments sent to zippartyrentals@gmail.com or 219-777-0902. In special cases, and only with prior discussion and approval from ZIP Party Rentals, we may also accept checks made payable to CLOSEFIT LLC or payment links through our website. Please note that website payments are subject to a 4% third-party payment digital payment fee. All alternative payment methods must be confirmed and approved in advance before proceeding.

 

Rental Duration.

All equipment, if not agreed differently, is being rented to a Renter for a 23 hours period. Any additional time is not guaranteed, unless discussed prior the agreement and specified in section “NOTES/SPECIAL REQUESTS. Renter Authority, Property Authorization & Full Responsibility

The individual signing this Agreement (“Renter”) represents, warrants, and confirms that they are either: The legal owner of the property where the rental equipment will be delivered, installed, stored, or used; or Have been fully authorized, delegated, and granted permission by the legal property owner to enter into this Agreement and authorize the use, placement, installation, and operation of all rental equipment on the property.

By signing this Agreement, the Renter acknowledges and agrees that ZIP Party Rentals is relying entirely upon the Renter’s representations regarding property authorization and permission. The Renter accepts full legal and financial responsibility for all rental equipment from the moment of delivery until complete pickup and return by ZIP Party Rentals, including responsibility for: Proper supervision and safe usage of all equipment; Informing all guests, attendees, vendors, contractors, invitees, and any third parties present at the event regarding the proper and safe use of all rental equipment; Preventing misuse, negligence, vandalism, theft, abuse, overcrowding, unsafe conduct, or unauthorized modifications to the equipment; Ensuring that all equipment is used only for its intended purpose and in compliance with all local laws, ordinances, safety rules, and manufacturer guidelines. 

The Renter further agrees that they shall remain fully responsible and liable for any and all damages, injuries, claims, losses, fines, legal disputes, property damage, bodily injury, death, or other incidents arising directly or indirectly from: The use or misuse of rental equipment; The placement or installation of equipment; Actions or negligence of guests, vendors, contractors, attendees, or third parties; The condition of the property; Any claim by the property owner or surrounding property owners If any dispute regarding permission or authorization for use of the property.

If at any time the legal property owner claims that: They were unaware of the event; They did not approve the rental equipment; They did not authorize the Renter to use the property; They did not consent to tent staking, installations, deliveries, or event operations; such claims shall NOT release the Renter from any responsibility or liability under this Agreement. The Renter shall remain fully responsible for: Any damage to ZIP Party Rentals equipment; Any damage to the property where equipment was placed; Any damage to neighboring or surrounding properties; Any underground or above-ground utilities; Any injuries, claims, lawsuits, fines, penalties, or legal expenses involving third parties. The Renter agrees to indemnify, defend, and hold harmless ZIP Party Rentals, its owners, employees, contractors, affiliates, and representatives from and against any and all claims, liabilities, lawsuits, damages, losses, costs, attorney fees, or expenses arising from any dispute related to property authorization, event permission, equipment usage, or damages connected to the rental. ZIP Party Rentals shall not be responsible for verifying ownership of the property, confirming permission from the legal owner, or investigating the authority of the person signing this Agreement. The signed Agreement itself shall serve as the Renter’s full legal representation that proper authorization has been obtained.

 

Utility Location, Site Direction & Safe Installation Responsibility

The Renter is solely and fully responsible for identifying, marking, and verifying all underground and above-ground utilities, hazards, private lines, and restricted installation areas prior to delivery or installation of any rental equipment. This includes, but is not limited to: Gas lines, Electrical lines, Septic systems, Sprinkler systems, Water lines, Drainage systems, Communication/internet cables , Invisible pet fences, Irrigation systems, Private utility lines, Any other underground or surface-level structures or hazards The Renter acknowledges and agrees that it is the Renter’s sole responsibility to contact Indiana 811 (or any applicable state utility locating service) prior to installation and to obtain all required utility markings and clearances before ZIP Party Rentals arrives at the property. The Renter further agrees to personally direct, designate, and approve the exact installation area for tents and all rental equipment and confirms that the designated area is safe, clear, utility-free, and suitable for installation. ZIP Party Rentals shall have no responsibility to independently verify utility locations, property boundaries, subsurface conditions, underground hazards, or installation safety conditions. If the Renter fails to: Contact 811, Properly mark utilities, Provide accurate utility information, Provide a safe installation location, Properly designate the installation area; then the Renter assumes full responsibility and liability for any resulting damages, losses, injuries, repair costs, claims, lawsuits, utility strikes, property damage, neighboring property damage, governmental fines, or third-party claims. The Renter agrees that any verbal or written direction given to ZIP Party Rentals installers regarding placement of tents or equipment shall constitute the Renter’s full acceptance and approval of the installation location and surrounding conditions. ZIP Party Rentals, its employees, installers, contractors, and representatives shall be fully released, indemnified, defended, and held harmless from any and all claims or damages arising from utility strikes, underground damage, unsafe installation conditions, or placement of equipment at the direction of the Renter.
